Welcome to Frame-it.me. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Frame-it.me ("we," "us," or "our"), concerning your access to and use of the Frame-it.me website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.

We provide a digital platform optimized for the visualization of artwork through various framing simulations. You agree that by accessing the Service, you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the site and you must discontinue use immediately.

In order to access certain features of the platform, such as saving visualizations or personalizing your workspace, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

• Confidentiality: You are responsible for safeguarding your password and for all activities that occur under your account.
• Unauthorized Use: You must immediately notify us of any unauthorized use of your account or any other breach of security.
• Right to Refuse: We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate.

Our Service allows you to upload, store, and display images ("User Content"). You retain any and all of your rights to any User Content you submit, post or display on or through the Service and you are responsible for protecting those rights.

By posting User Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, process, and display that content in connection with the Service. This license is solely for the purpose of enabling us to provide the digital framing visualization tools to you.

You represent and warrant that: (i) the User Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Frame-it.me is a visualization tool, not a permanent file storage solution. To optimize platform performance and ensure high-speed processing for all users, we implement a strict temporary data retention policy.

Deletion Cycles: User-uploaded images may be automatically purged from our active servers after a predetermined period of inactivity or upon the conclusion of a session. While we strive to maintain your data for your immediate workflow, we make no guarantees regarding the duration of this storage.

User Responsibility: It is your sole responsibility to maintain local backups of all original files. Frame-it.me shall not be held liable for the loss of any User Content due to our automated deletion processes.

To deliver an efficient and robust experience, we utilize third-party infrastructure and service providers for tasks including, but not limited to, image hosting, server management, and technical analytics.

By using the Service, you acknowledge and agree that your User Content may be transferred to and processed by these third-party providers. We ensure that all such partners are vetted and bound by confidentiality agreements to handle your data in accordance with modern security standards. However, we are not responsible for the privacy practices or content of these third-party services beyond our contractual reach.

You may not access or use the Service for any purpose other than that for which we make the Service available. As a user of the Service, you agree not to:

• Systematically retrieve data or other content from the Service to create or compile a collection, database, or directory without written permission.
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information.
• Circumvent, disable, or otherwise interfere with security-related features of the Service.
• Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the Service.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

These Terms shall be governed by and defined following the laws of your jurisdiction. Frame-it.me and yourself irrevocably consent that the courts of said jurisdiction shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

These Terms of Service shall remain in full force and effect while you use the Service. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF SERVICE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.
